Klio terms of service

These Terms of Service ("Terms") govern your use of the Klio application ("App") provided by BRYLABS ("we", "our", or "us"). By downloading, installing or using the App, you agree to be bound by these Terms.

1. Acceptance of terms

By accessing or using Klio, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. License to use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App on devices that you own or control, strictly in accordance with these Terms and any applicable usage rules set forth in the Apple App Store Terms of Service.

3. User accounts and data

Klio does not require you to create an account with us. Your journal entries and data are stored locally on your device and, if you choose to enable it, in your personal iCloud account. You are responsible for maintaining the security of your device and iCloud account.

4. User responsibilities

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not use the App in any way that could damage, disable or impair the App
• Not attempt to reverse engineer, decompile or disassemble the App
• Not use the App to create, store or share content that is illegal, harmful, threatening, abusive or otherwise objectionable
• Take responsibility for all content you create and store using the App

5. AI-powered features

Klio includes optional AI-powered writing assistance. When using these features:

• AI-generated content is provided as suggestions only. You are responsible for reviewing and editing any AI-generated text before saving.
• AI responses may occasionally be inaccurate, incomplete or inappropriate. We do not guarantee the quality, accuracy or suitability of AI-generated content.
• You retain full ownership of your journal entries, including any portions created with AI assistance.
• The AI feature requires an internet connection and is subject to the availability of third-party AI services.

6. Subscriptions and payments

Klio may offer subscription-based premium features. If you choose to subscribe:

• Payment is processed through Apple's App Store. We do not have access to your payment information.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription through your Apple ID account settings.
• No refunds will be provided for partial subscription periods, except as required by applicable law or Apple's policies.
• Prices may change with reasonable notice, and continued use after price changes constitutes acceptance of the new pricing.

7. Intellectual property

The App, including its design, features, code and content (excluding user-generated content), is owned by BRYLABS and is protected by copyright, trademark and other intellectual property laws. You may not copy, modify, distribute or create derivative works based on the App without our express written permission.

You retain all rights to your journal entries and content created using the App.

8. Third-party services

The App integrates with third-party services including Apple's iCloud and Google's Gemini AI. Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy or content of third-party services.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any AI-generated content.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRYLABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP OR ANY SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless BRYLABS and its officers, directors, employees and agents from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

12. Data loss

While we have designed Klio to store your data securely on your device and in iCloud, we are not responsible for any loss of data due to device failure, iCloud service issues, accidental deletion or other causes. We recommend regularly backing up your device.

13. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us or third parties.

14. Changes to terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through the App or other means. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BRYLABS regarding your use of the App and supersede any prior agreements.
